AI Plant & Product Advisor — Important Notice
The AI Plant & Product Advisor ("the Advisor") provides general gardening information and product suggestions only. It does not constitute professional horticultural, veterinary, or medical advice.
Before acting on any recommendation, independently verify suitability for your specific soil, climate, and household — including the presence of children, pets, or individuals with allergies.
Some plants and products may be toxic or harmful if misused. Always read manufacturer instructions. In a medical or veterinary emergency, contact NHS 111, 999, or your vet — do not rely on the Advisor.
AI-generated advice may be incomplete or unsuited to your circumstances. Heritage Gardens accepts no liability for loss or damage arising from reliance on the Advisor. Full terms in Section 12 of our Terms & Conditions.
Ownership of the AI Advisor Service
All Rights Reserved
The Advisor — including its system design, integration architecture, prompt engineering, knowledge curation, and recommendation logic — is the exclusive intellectual property of Heritage Gardens ("Company IP").
Legal Protection
Company IP is protected under UK law, including the Copyright, Designs and Patents Act 1988, the Trade Secrets (Enforcement, etc.) Regulations 2018, and the law of confidence.
No Licence Implied
No licence, right, or interest in any Company IP is granted to you by your use of the Advisor, except as expressly set out in these terms.
Pioneer Service
As one of the first AI-integrated garden advisory services in UK e-commerce, Heritage Gardens asserts all available IP rights in the Advisor concept, execution, and outputs.
Database Rights
Clause 3.1 — Protected Databases. The Heritage Gardens product catalogue, plant knowledge base, horticultural data sets, and curated content that underpin the Advisor constitute databases in which Heritage Gardens holds database rights under the Copyright, Designs and Patents Act 1988. These rights arise from substantial investment in obtaining, verifying, presenting, and maintaining the contents of those databases.
Clause 3.2 — Prohibited Extraction. You must not extract or re-utilise all or a substantial part of the contents of any Heritage Gardens database — whether by scraping, automated querying, bulk download, or any other means — without our prior written consent.
Prohibited Uses
Without our express prior written consent, you must not:
- Copy, reproduce, adapt, or create derivative works from any Advisor output.
- Use Advisor outputs for any commercial purpose beyond personal garden planning.
- Use automated tools, bots, crawlers, or scraping software to query or harvest data from the Advisor or website.
- Attempt to reverse engineer, decompile, or derive the source code, system prompts, logic, or methodology of the Advisor.
- Use Advisor outputs to train, develop, or improve any competing AI system, recommendation engine, or advisory service.
- Sub-licence, resell, or commercially exploit any output, recommendation, or information provided by the Advisor.
Breach of these prohibitions may constitute infringement of our intellectual property rights and/or misappropriation of trade secrets, in respect of which we reserve the right to seek injunctive relief and all other remedies available under English law without the requirement to prove actual financial loss.
Advisor Outputs — IP Status & User Licence
- 5.1 All intellectual property rights in outputs generated by the Advisor ("Advisor Outputs"), to the extent they subsist, vest in Heritage Gardens.
- 5.2 Subject to compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use Advisor Outputs solely for your own personal, non-commercial gardening purposes.
- 5.3 This licence does not extend to: commercial use; publication or broadcast; use in training or fine-tuning AI systems; or any use that competes with or replicates the Advisor service.
- 5.4 You acknowledge that Advisor Outputs are AI-generated, may be incomplete or imprecise, and should not be acted upon without independent verification.
Trade Secrets & Confidential Information
Clause 6.1. The system architecture, prompt engineering, model configuration, product-matching logic, training data curation, and integration methodology of the Advisor constitute trade secrets and confidential information within the meaning of the Trade Secrets (Enforcement, etc.) Regulations 2018.
Clause 6.2. You acknowledge that unauthorised acquisition, use, or disclosure of such confidential information may cause substantial harm to Heritage Gardens, and that we reserve the right to seek injunctive relief and all available remedies without proving actual financial loss.
Clause 6.3. Nothing in your use of the Advisor grants you any right to access, inspect, or reverse-engineer the underlying confidential systems, data, or methodology.
Brand & Trade Mark Protection
Clause 7.1. Heritage Gardens, heritagegardens.co.uk, and associated logos and marks are trade marks or registered trade marks of Heritage Gardens. You must not use any of our marks in a way that implies association, endorsement, or equivalence with the Advisor or any other product or service.
Clause 7.2. You must not misrepresent the source of advice obtained from this service or pass off outputs as having originated from a different or competing service.
Clause 7.3. Nothing in your use of the Advisor grants you any right to use our trade marks, trade names, logos, domain names, or other brand features.

These clauses are published in good faith as an interim measure while Heritage Gardens completes a full IP and legal review with a qualified UK solicitor. They reflect best practice guidance as of June 2026 and will be updated following that review.
UK law governing AI-generated content and intellectual property is in active development. The Data (Use and Access) Act 2025 requires the UK government to monitor copyright reform, and further legislation is anticipated in late 2026. Heritage Gardens will update this page when material changes occur.
