3.    These Terms & Conditions (“Terms”), together with our Privacy Policy and Cookie Policy, govern your use of our website and any purchase you make from us. Please read them carefully before using the site or placing an order.

1.    By accessing heritagegardens.co.uk, you agree to these Terms. If you do not agree, please do not use the site.

2.    You must be at least 18 years of age to make a purchase. By placing an order, you confirm that you meet this requirement.

3.    We reserve the right to restrict access to any part of the website at any time without notice.

4.    You must not misuse this website by knowingly introducing viruses or other malicious or technologically harmful material, or by attempting to gain unauthorised access to our servers or any connected systems.

1.    Our product listings are invitations to treat, not binding offers. A contract between you and us is formed only when we send you an order confirmation email following our acceptance of your order.

2.    We reserve the right to decline or cancel any order, for example if a product is out of stock, if there has been a pricing error, or if we are unable to verify your payment. We will notify you promptly and issue a full refund if payment has been taken.

3.    Prices shown on the website are in pounds sterling (GBP) and include VAT at the prevailing rate unless otherwise stated. We reserve the right to change prices without notice prior to order confirmation.

1.    We accept payment by major debit and credit cards and other methods displayed at checkout. Payment is taken at the point of order.

2.    All payment data is processed by our PCI DSS-compliant payment provider. We do not store your card details.

3.    If a payment is declined or later charged back, we reserve the right to cancel the related order and recover any goods already despatched.

1.    We currently deliver to UK mainland addresses only unless otherwise stated at checkout. Delivery charges and estimated timescales are shown at checkout and in your order confirmation.

2.    Delivery times are estimates only. We are not liable for delays outside our reasonable control, including adverse weather, carrier delays, or circumstances arising from events such as strikes or supply disruption.

3.    Risk in goods passes to you on delivery. Ownership passes to you when we have received payment in full.

4.   Please inspect all goods arrival and notify us of any damage within 48 hours by emailing hello@heritagegardens.co.uk with a description and photographs.

Faulty Goods

6.    If goods are faulty, misdescribed, or not fit for purpose, you have rights under the Consumer Rights Act 2015 including the right to a repair, replacement, or full refund. These rights are in addition to your cancellation rights and are not affected by these Terms.

12.1  Nature of the Service

1.    The AI Plant & Product Advisor (“the Advisor”) is an automated tool that uses artificial intelligence to provide general gardening information, plant care suggestions, and product recommendations based on the information you submit and our current product catalogue.

2.    The Advisor is provided for general informational and guidance purposes only. It does not constitute professional horticultural, agricultural, veterinary, medical, or other specialist advice.

3.    AI-generated responses may on occasion be incomplete, generic, out of date, or unsuited to your specific circumstances, including your local climate, soil type, microclimate, and the health of individual plants.

12.2  No Guarantee of Outcome

4.    We make no representation or warranty that any advice, planting plan, diagnosis, care recommendation, or product suggestion provided by the Advisor will be accurate, suitable for your situation, or result in any particular outcome, including the survival, growth, or health of any plant.

5.    Gardening outcomes depend on many factors outside our control, including weather, soil conditions, watering, and pest and disease pressure. Acting on the Advisor’s guidance is at your own discretion and risk.

12.3  Plant, Pet & Personal Safety

6.    Some plants and products discussed or recommended by the Advisor may be toxic or harmful if ingested, handled, or used incorrectly — including to children, pets, livestock, or individuals with allergies or sensitivities.

7.    While the Advisor may flag known safety considerations, it should not be treated as a complete or authoritative source of safety information. You are responsible for independently verifying the toxicity, allergenic potential, and safe use of any plant or product before purchase or use.

8.    In a medical or veterinary emergency, contact NHS 111, 999, or your veterinarian immediately. Do not rely on the Advisor in an emergency.

9.    For pesticide, herbicide, and fertiliser products, always follow manufacturer label instructions and comply with all applicable UK regulations.

12.4  Product Recommendations

10. Product recommendations are generated on the basis of the information you provide and our catalogue at the time of the conversation. They do not constitute a warranty that any product is fit for your particular purpose.

11. Your statutory consumer rights in relation to goods purchased through Heritage Gardens under the Consumer Rights Act 2015 are unaffected by this section.

12.5  Your Responsibility

By using the Advisor, you accept responsibility for exercising your own judgement before acting on any guidance, including by:

•       checking plant hardiness, invasiveness, and suitability for your specific region and soil type;

•       reading and following manufacturer instructions and safety guidance for any product;

•       taking appropriate precautions where children, pets, or vulnerable people may access your garden; and

•       seeking professional advice (horticultural, veterinary, or medical) where the stakes of a decision warrant it.

12.6  Limitation of Liability for AI Advisor

12. To the fullest extent permitted by law, Heritage Gardens accepts no liability for any loss, damage, cost, or expense arising directly or indirectly from your use of or reliance on advice, recommendations, or information provided by the Advisor, including without limitation: loss of or damage to plants, gardens, or property; personal injury or illness arising from use of a plant or product.

13. Nothing in this clause excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under applicable UK law.

12.7  Availability & Changes to the Advisor

14. We may update, suspend, or withdraw the Advisor at any time without notice and are not liable for any consequences arising from its unavailability.

1.    These Terms are governed by the law of England and Wales. Any dispute arising from these Terms or your use of our website or purchase of our products shall be subject to the exclusive jurisdiction of the courts of England and Wales.
